Overview

The case brief enables you to develop fundamental legal skills to analyze the decisions of courts and their way of reasoning. Case Briefing is a fundamental skill to understand the legal doctrines which sustain legal decision making. The Case Brief enables you to learn how to synthesize the main aspects of legal cases which are an essential tool to learn international normative ideas.

Instructions

For the Case Brief, choose the case from the assigned Module: Week’s reading that you find most influential and interesting and write a brief. The Case Brief should include the following:

·         Must be at least 500 words.

·         Must follow current Bluebook format, and include the following sections:

o   Caption with the correct case name and a proper citation

o   Facts in chronological order

o   Procedural history in chronological order

o   Issue combining applicable law, items presented to court, and relevant facts into 1 question

o   Rule of law stating the legal test that the court applied to resolve the legal issue

o   Holding providing a brief and accurate summary of the court’s ruling

o   Rationale containing the court’s analysis through a concise explanation
